TERMS OF SERVICE

1. Introduction
These Terms of Service (“Terms”) govern all services provided by Tumascho Services (“we”, “us”, “our”), including but not limited to business registrations, consultancy, web hosting, website development, digital services, and related support.
By using our services, you (“client”, “you”, “your”) agree to be bound by these Terms.
2. Scope of Services
We provide:
- Business registration and consultancy services
- Web hosting, domain services, and email services
- Website development
- Compliance documentation support
- Advisory and administrative assistance
The client understands that processing times, approvals, and outcomes involving third-party institutions (BIPA, NAMRA, Social Security, NAMFISA, domain providers, etc.) are outside our control.
3. Client Responsibilities
The client agrees to:
- Provide accurate and complete information
- Respond to requests for documents in a timely manner
- Ensure all fees are paid before work begins
- Review drafts/output within 48 hours when requested
- Use services lawfully
Tumascho Services is not responsible for delays caused by incomplete information, late submissions, unpaid fees, or third-party institutions.
4. Payments & Fees
All prices are listed in Namibian Dollars (NAD).
Payments must be made in full upfront unless otherwise agreed in writing.
Once payment is received, work may begin immediately, and therefore:
- All payments are final and non-refundable unless stated under our Refund Policy.
- Payments for third-party obligations cannot be reversed (BIPA fees, domain fees, hosting fees, SSL certificates, emails, etc.).
- If a client cancels after work has begun, the full fee remains payable.
5. Intellectual Property
For website development:
- Final delivered websites become the client’s property upon full payment.
- All drafts, concepts, unfinished work, or internal files remain the intellectual property of Tumascho Services unless explicitly transferred in writing.
We reserve the right to display completed websites in our portfolio.
6. Service Availability
Web hosting & domains rely on third-party systems.
We do not guarantee:
- 100% uptime
- Email deliverability
- Zero interruptions or cyber-attacks
We will make reasonable efforts to maintain service availability.
7. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for losses, including financial loss, data loss, business loss, loss of profits, delays, or consequential damages.
- We do not guarantee approval of any registrations (BIPA, NAMFISA, NAMRA, visas, etc.).
- We are not responsible for delays caused by third parties.
Our maximum liability, under any claim, is limited to the amount paid for the specific service.
8. No Legal, Tax, or Financial Advice
Information provided is for administrative assistance only.
We do not provide legal, tax, or financial advice unless explicitly stated.
9. Refusal of Service
We reserve the right to:
- Decline any client
- Terminate services at any time
- Withhold documents until outstanding balances are paid
10. Amendments
We may update these Terms at any time.
Continued use of our services means acceptance of updated Terms.
